Definition of Disposition Disbarment is a determination that the lawyer has engaged in misconduct warranting the most serious sanction. The disbarred lawyer is not authorized to practice law during the period of the disbarment and may not return to the practice of law unless and until he or she has demonstrated his or her rehabilitation, good character, and current knowledge of the law in a subsequent reinstatement case, which may not be filed until five years after the effective date of the disbarment.
Case Summary Mr. Pruitt, who was licensed in 2000, was disbarred. After he filed a complaint for his client in a personal injury matter on the final day of a two-year limitations period, Mr. Pruitt did not place the complaint and summons for service or take any other action for his client, and ceased returning the client’s calls. Mr. Pruitt also was also arrested in Kentucky for the offense of driving while under the influence of alcohol and pled guilty to that offense. Finally, he did not cooperate with the ARDC investigations in relation to those incidents.

After he agreed to serve as an intermediary to receive $400 every month from his client’s ex-husband and disburse those payments to his client, he did not inform his client of many of the payments that he received for her, and he knowingly misappropriated $4,894 of the funds. He also failed to keep records of his client trust account. He did not participate in his disciplinary proceeding.
