Definition of Disposition Disbarment is a determination that the lawyer has engaged in misconduct warranting the most serious sanction. The disbarred lawyer is not authorized to practice law during the period of the disbarment and may not return to the practice of law unless and until he or she has demonstrated his or her rehabilitation, good character, and current knowledge of the law in a subsequent reinstatement case, which may not be filed until five years after the effective date of the disbarment.
Case Summary Mr. Horn was licensed in Florida in 1983 and in Illinois in 1984. The Supreme Court of Florida disbarred him, by default, after he was charged with misconduct in connection with his representation of two clients in unrelated criminal matters. In one matter Mr. Horn agreed to go to trial despite not having prepared for trial. In the other matter, he took a fee and filed a motion but failed to set the motion for hearing and then performed no other services for the client. Mr. Horn also failed to refund unearned fees and failed to respond to lawful demands for information from Florida disciplinary authorities. The Supreme Court of Illinois imposed reciprocal discipline and disbarred him in Illinois.

He was suspended for thirty days by the Supreme Court of Florida for misconduct involving his plea of guilty to committing misdemeanor traffic offenses and his failure to appear in court on an order to show cause. He also neglected one case and failed to return documents to a client. The Illinois Supreme Court imposed reciprocal discipline and suspended him for thirty days. The suspension is effective on February 4, 2005.
